By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, and payment information. You represent and warrant that all the information you provide is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity.

2. Our Products

While we aim to create something deeply moving and meaningful, the final result may differ from what you initially imagined. As with any creative service, interpretations and emotional responses can vary. We do not warrant that the appearance, quality, or emotional impact of any products or services purchased by you will meet your expectations or be the same as depicted or rendered on our website. All descriptions of products are subject to change at any time without notice at our sole discretion.

3. Orders

When you place an order, you are making an offer to purchase. StorySongfy reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until StorySongfy confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale.

4. Prices and Billing

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed. Unless otherwise expressly stated, posted prices do not include applicable taxes.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our website, and to promptly update your information so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorized to use such payment method for the purchase, and (iii) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any.

5. How Songs Are Created and Delivered

We create personalized songs based on your quiz responses. Depending on the delivery option you select at checkout, your song is generated on a "30-Minute Delivery" or "48-Hour Delivery" basis. A free preview of your song is generated and made available to you before you are asked to pay. Payment unlocks the full-length song and, where applicable, the lyrics PDF add-on.

Fulfillment times are estimates and may vary based on order volume, the complexity of your request, or unforeseen circumstances, though we make every effort to meet the stated timelines.

All songs are delivered digitally (audio file) via the Site and/or the email address you provide. It is your responsibility to ensure the email address you provide is accurate and capable of receiving our messages. Please check your spam or junk folder if you do not see a delivery notification.

6. Subscription & Cancellation

Certain Services are billed as a recurring subscription. Full details on how subscriptions renew and how to cancel are set out in our Subscription & Cancellation Policy, which forms part of these Terms.

7. Refunds

Because songs are personalized to you and a free preview is provided before payment, purchases are generally final once payment is made. Full details, including our 30-day money-back guarantee and how to request a correction, are set out in our Refund Policy, which forms part of these Terms.

8. Intellectual Property

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, and audio, and the design, selection, and arrangement thereof, are owned by StorySongfy, its affiliates or licensors and are protected by applicable copyright and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material on the Services without our prior written consent.

Subject to applicable law and our Privacy Policy, you grant StorySongfy a perpetual, worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, distribute and create derivative works from — including for marketing and promotional purposes — (a) materials you provide to us; (b) any outputs (songs, lyrics) delivered to you; and (c) your communications with us. You represent and warrant that you have all necessary rights and consents for any names, likenesses, or personal data of others you provide, including minors, and that you are the parent or legal guardian of any minor whose information you provide or have verifiable parental consent.

9. Optional Third-Party Tools

You may be provided with access to tools offered by third parties as part of the Services (for example, our payment processor), which we neither monitor nor control. Such tools are provided "as is" and "as available" without any warranties. Your use of any third-party tools is entirely at your own risk.

10. Third-Party Links

The Services may contain hyperlinks to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. If you leave the Services to access these materials, you do so at your own risk.

11. Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read it.

If you submit any ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback for any purpose, including commercial use. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice.

You may not use the Services to violate any law, infringe our intellectual property rights or the rights of others, harass or harm any person, transmit false or misleading information, send spam, impersonate any person or entity, upload viruses or malicious code, or interfere with or circumvent the security features of the Services. We may terminate this agreement or your access to the Services at our sole discretion at any time, and you will remain liable for all amounts due up to the date of termination. Sections that by their nature should survive termination (including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, and Governing Law) will continue to apply.

WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

17. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL STORYSONGFY, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF ANY GIVEN PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THAT PURCHASE. THIS LIMITATION DOES NOT APPLY WHERE PROHIBITED BY LAW.

18. Indemnification

You agree to indemnify, defend and hold harmless StorySongfy and our affiliates, partners, officers, directors, employees, agents, contractors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, arising out of (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed, without affecting the validity of the remaining provisions.

20. Waiver; Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms and any policies referenced herein constitute the entire agreement between you and us regarding the Services, superseding any prior agreements.

21. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in the United States, and you consent to personal jurisdiction in those courts.
